What is the annual report?
The annual report is an annual obligation for every employer covered by the Labour Code, set out in article 112 of Law no. 102/2009. It is submitted on the Ministry's annual report platform (GEP/MTSSS) and brings together several annexes on the company's employment, training and Occupational Health & Safety activity.
What is Annex D?
Annex D is the part of the annual report dedicated to the activity of the Occupational Health & Safety services. It is filled in by every employer, whether or not an organised service exists, and describes what was done during the year in terms of prevention.

Who has to submit
Every employer with workers is required to submit. In practice, this includes everyone from the micro-company with a single worker to the largest organisations, which is why external Occupational Health & Safety services end up managing Annex D for dozens or hundreds of client companies at the same time.
Submission deadlines

What is Annex D of the annual report?
It's the annex reporting the company's Occupational Health & Safety activity during the year: exams, training, risk assessments, accidents and how the service is organised. It is filled in by every employer, whether or not an organised service exists.
Who is required to submit the annual report?
Every employer covered by the Labour Code, with workers, must submit the annual report each year.
Can I delegate Annex D submission to my external service?
Yes. A company can delegate filling in Annex D to its provider, through the annual report platform, by NIF delegation. That delegation is valid only for the current year and must be renewed annually.
What happens if I don't submit?
Failure to submit is a serious administrative offence, punishable with fines ranging from 612 € to 9,690 €.
